actually snakes have come thru the post office, along with many other animals. some offices are more strict than others, some give better care and attention to animals than others. either way when shipping live animals it is STRONGLY recommended that it is shipped EXPRESS MAIL with clear markings on the box of whats inside and what care is needed. like i said most offices will try their best to accomidate that. now why yours stopped with tracking might be a number of things, weather, traffic, overload at that facility, depending on the type of shipping it may only require a scan at arrival unit and delivered scan, maybe in your case that label cant be read (which is quite often) or scanned, or it got misdirected (which also happens). which is why its recommended express mail. express and registered mail are the most secure mail there is. either way i hope your new additions get you safely.

Well I dunno. All I know is they have strict guidelines that say NO snakes, but some other animals are permitted.

Ok, here's what the law says:
If you RECEIVE the snakes, KNOWING they were mailed to you in an improperly marked package, you ARE breaking the Lacey Act law. And the fines are very high if you are caught. It's not only the shipper who is cited, but also the receiver.
Your only recourse to avoid becoming an accomplice is to reject the package when it arrives. But of course, no compassionate person would do such a thing, because the animals would most likely die as a result of it.
This is how these bad shippers keep going on the way they are--they make their buyers into accomplices. Anyone who signs for and accepts such a package cannot make a complaint, because they themselves are in violation of the law.
This is obviously a very BIG problem with the Lacey Act, but at the moment, that is the way things are.
And I'm sorry, but no one who ships a snake through USPS is a good guy. Maybe they were once, but this behavior pretty much eliminates it. That's like saying 'oh, this guy deliberately sent me a dead snake once, but that was just one incident, he's always been a good guy to deal with'. REALLY???
But this is even worse. This is turning his customer into a criminal, as well as risking the lives of the animals the customer paid for. How is this the behavior of a GOOD guy?

yes they were mailed overnight express and were guaranteed to be here by noon today. that did not happen, tracking info stopped last night, and nobody can find the package. the thought of these snakes curled up all cold in somewarehouse is making me sick though i just hope to hell they made it out of vt because today is like the first actual chilly day. I know it's nov but i'm still wearing shorts out but this was to be the last thing i ordered untill the spring. i still have my fingers crossed it makes it here tom. and they are still alive and well. i just hope your right and they wont confiscate it. I mean what would they do w/ the snakes if they did?

well express mail is a high priority with us and if it didnt make it before noon then there is a good chance it was confiscated from one of the hubs. pm me with the scan and ill try and check it out for you

Hope they turn up for you!! The weather wouldn't worry me too much at this time but more the dehydration factors. If they are packaged well though you should be good. Keep us posted!!

i mean that would still suck but atleast they'd be alive. i just hope they arrive tom. safe and sound. i've spent my entire day on the phone trying to track them down and looking up online if they can survive. i've made myself sicck with worry!!

I'm also sorry to hear that they were lost, but he made a HUGE mistake shipping them through USPS, since it IS a violation of the Lacey Act and both you and he could face stiff monetary fines as well as imprisonment if the USPS decided to prosecute if they realize he shipped snakes.
The likelyhood of that happening doesn't seem to be huge, as I've not heard of anyone prosecuted, however, the fact is that he just committed a felony by shipping them and you are equally liable if you accept them (if found out).
Good luck, I hope they arrive safely, but he's on my list of someone not to do business with now. Anyone in the "biz" as long as you say he's been knows this.

Ok i have read every single post. First off I agree with those who think we have an overly jumpy moderator who should not be bashing people so fast before reading entire posts. Whats that job description again??
As for the snakes.
The seller might be a "good guy" but you only need to make one HUGE mistake like this to ruin your reputation.
I could completely understand if he did ship via FedEx or UPS and the snakes were lost as long as he did reinburse you but he didnt. In fact he flat out lied to you, his high paying customer.
As a reputable breeder he should know the horrible consequences if he chose to take that shortcut.
Its not that he didnt know. Or he is new to the game. He knew and he lied. That is where the difference is. Does everyone really think that he should be allowed to keep his untarnished reputation even if he makes this right?
It would be one thing if he shipped FedEx like he said he did. Then lost the snakes and refunded the buyer. That would be what a responsible person would do. It would deserves respect and understanding that the mistake was not his fault & he did in fact make it right.
This is not what happened. He was fully aware its illegal to ship through the mail. This "good guy" of a breeder is a liar. That is bad business. Period.
You have my condolences and i seriously do hope the snakes arrive ok for you.

Hi,
I was only implying that this guy has a clean past and has not been noted for messing things up before. So I was only trying to ease the buyers mind that Dan should fix things and rectify any monetary loss. I am not or did not imply he should move on with a clean slate. Not at all. But lets wait and get the full story before Dan Foley is hung without a fair trial. You all know the drill. And thank you for addressing the administrator. I never got an apology.

It happened to me. 13ft retic was shipped delta dash from miami fl to ftw tx. the crate was picked up by the wrong loading crew and put on a different airlines all together. At that point the tracking was no longer possible. 4 days later we received a call from mexico city warehouse. WTF! the shipper had already mailed me a check for a full refund as soon as he was imformed that the package was lost. this opened all kinds of legal actions when customs found out. It was december . I did finally recieve the crate 8 days later. she was like a piece of ice and started condensating when we pulled her out of the crate. the shipper told me to hold the check and if anything happens to the animal in the next 4 months cash it. theres alot more to this story but to much to list. maybe every thing will work out ok. The shipper should refund your money in full if things go bad!

wow that is such a predicament to be in. i mean how to u send these animals to their death by refusing to receive due to this mishap. :O i mean i just don't even think that's an option, but if he does break the cuffs out after i sign best believe i'm bolting to the reptile room, locking the door, and putting them in their nice warm cages first!!! i really don't want to be a convicted felon over this though either!!!

Oh I do agree with you. I do not believe he should be "hung" but I do not think this should go unannounced even if he does make it right should the snakes never be found..
I believe a situation like this would warrant a BOI rating which explains the situation. No heresay. Just truth.
If the snakes are not found and the seller refunds the buyer it should be posted that he did rectify the situation but it should be posted as to why there was a problem in the first place. Because I personally would not trust anyone to not make the same mistake twice.
You're right though. It all depends on the outcome. Its already out there at this point. We already know, so what happens from here on out is just a wait n see.

i just hate being on this end of the wait and see, and i know the snakes can't be happy with this. I just hope they are packaged up good and not all cold in some warehouse or worse out in a truck overnight. talk about a long, day and even longer night, just want tom. to come and hopefully they get here!!!

There is absolutely NO excuse to ship a snake via USPS, people like this make the rest of us look bad and right now it’s only adding fuel to the fire. We are fighting for our right to keep our animal and someone goes and does that……………..WTF
To the OP I hope your animal are delivered tomorrow and are safe and sound however I would not drop the issue and report the seller in question

Being a former mailman for the USPS I can tell you that Express Mail is ran 365 days a year and some Express Mail takes up to two days to deliver depending on where the package was shipped from and where you are.

wow insane im a mail carrier for the usps
and ive seen instances where express mail doesnt make it by the scheduled time
when its get accidentally re routed or whatnot
any package with a confirmation scan should have full details because its supposed to be scanned at every stop but of course sometimes barcodes are overlooked.
im really sorry youre going thru this i would be freaking out
i hope your snakes arrive tomorrow in good condition :)

oh yeah def. some freaking out. my sister and girlfriend said i was making them nervous while i waited earlier today, pacing the house on hold w/ usps and "running to the blinds like a crackhead everytime i heard a car" but the closer it got till 5 the more anxious i got. now i've pretty much just accepted theres nothing i can do but wait. I'm supposed to go out of town for a meeting on monday. if they aren't here tom. there's noooo way i'm goin anywhere. i just hope they are here tom. i will keep u all informed. again fingers crossed.

It depends, if it's before 8pm BG will read them...the later it gets..the lazier BG gets. This was early so BG must not have had his diet coke and didn't read it properly.

Let me say this also. We are ASSUMING that this seller said he was gonna ship it UPS or Fed X. Now he may have lied about how he was gonna ship it, or there may have been a misunderstanding of how he was gonna ship it. BG misunderstood...so if BG can make that mistake....any normal human can. We really need to hear from the shipper before saying he lied for sure.

i definitely understand the concept of "you get what you pay for" being into the whole tattoo scene. the saying goes for anything. tattoos, snakes, photographic prints, even cars. yes i know, i should have found out the sizes before but, with snakes lost in transition i don't really think that's the most important thing here. i was just shocked to see them being so expensive because everytime i look at even proven adult breeder prices in US funds, they are almost always hundreds of dollars lower than CAN funds. snake morphs are not nearly as readily available up here.
the reason i was so quick to jump and say "SCAMMER" was because someone tried to pull a scam on me once, with a pied female. they pushed and pushed and pushed asking for my credit card # and that as soon as i give them my credit card # they would "ship the snake right away," and they were apparently from saudi arabia or something like that (i forget the specifics) and had a business name that i could find nowhere on the internet, and no information about.
i have never heard anyone being so pushy, so at that point i just told them i do not have a credit card, and they immediately said "ok thanks bye" in a foreign accent, and then hung up.
i see now it's clearly not a scam, but the transaction clearly didn't go the way it was supposed to. i'm still rooting for these snakes to turn up safe and alive!!

i definitely understand the concept of "you get what you pay for" being into the whole tattoo scene. the saying goes for anything. tattoos, snakes, photographic prints, even cars. yes i know, i should have found out the sizes before but, with snakes lost in transition i don't really think that's the most important thing here. i was just shocked to see them being so expensive because everytime i look at even proven adult breeder prices in US funds, they are almost always hundreds of dollars lower than CAN funds. snake morphs are not nearly as readily available up here.
the reason i was so quick to jump and say "SCAMMER" was because someone tried to pull a scam on me once, with a pied female. they pushed and pushed and pushed asking for my credit card # and that as soon as i give them my credit card # they would "ship the snake right away," and they were apparently from saudi arabia or something like that (i forget the specifics) and had a business name that i could find nowhere on the internet, and no information about.
i have never heard anyone being so pushy, so at that point i just told them i do not have a credit card, and they immediately said "ok thanks bye" in a foreign accent, and then hung up.
i see now it's clearly not a scam, but the transaction clearly didn't go the way it was supposed to. i'm still rooting for these snakes to turn up safe and alive!!
It's just one of Big Gunns many pet peev's. BG hates it when the "forum police" always ASSUME the worst of the breeder without knowing all the facts. You wouldn't like it if your name came up in a thread that had the word "scammer" in it now would you?:P

BG.. We are not assuming the shipper said he would ship via fedex or ups. You missed that part too. Read back. The poster said that the shipper stated he always ships via fedex. That means the shipper lied. If was obviously asked what shipping methods he uses. He told the buyer he always ships via fedex. He then shipped via us mail. Better hurry and drink your caffene.

Let me say this also. We are ASSUMING that this seller said he was gonna ship it UPS or Fed X. We really need to hear from the shipper before saying he lied for sure.

OK UPDATE. it's 4:30 in the morning and i woke up and my laptop was right there on the night stand open so i clicked refresh not expecting anything new on the tracking screen and it popped back up on the radar at the shipping facility in richmond va where i live!!!!!!!i just jumped up all gung ho trying to call around and find it and go get it and yeah nothings open and nobody to talk to. guess i gotta just go back to bed on that note but they will be here in the morning OMG i hope they are ok pleaaaaaaaaaaaaaaaaaaaaase be ok now that they popped up. i'll let u know in a few more hours.....

Don't fret too much over the legal aspects--many folks have to receive unmarked shipments every year and have done so without issue. USPS doesn't know what's in there, unless you tell them. There have been Lacey Act stings in the past, but it's extraordinarily unlikely that your little shipment would be among them.
It's not right, but that's the way it is.
As for 'mistakes'. A mistake is "Oops, I forgot to enclose that piece of paperwork!".
When you use a completely different shipper than you said you would, and lie about the contents of the package on the label, that is not a 'mistake'. That is a crime.

i'd say more of a nightmare than mistake anyways. I'mjust soooo happy they are in richmond i just hope they are still alive i have faith. i can't go back to sleep now though just gonna keep callin every hour till somebody gets there to see if i can go pick it up. i'm sure time is of the essence at the moment. i will hopefully be telling u all they are alive and well here very very shortly :please: thanks for all the prayers and crossed fingers!!!

ok well somebody finally answered the phone. then i got the number that my express mail goes to. talked to a lady there that said that they don't pick there express mail up till 9:30 or 10 and there was no way the facility they get it from would release it to me. but that she would call me as soon as it is in her sight and keep it untill i get there. all i can do is cross my fingers but now thats atleast 3.5 more hours.

Good luck! I'm sorry you've been going through much more trauma than is necessary with this shipment. I just hope for your sake they arrive alive. I know I would never order from that breeder again if I went through this. I'm just glad you know where they are now, and I hope they get there alive and healthy.

Big Gunns knows what he said. Bg was just saying that you are "assuming" that what the OP is saying is the 100% truth. BG isn't calling him a liar, so don't get your snake bags in a bunch. THEY ARE ALIVE!!!!!!!! AND beautiful!!!!! jusst put them away to warm up, they were a smooth 65degrees with the infared gun!!!! the male bee straight shot out the bag. the superpastel i was worried about but she is very much alive, just needed the car right in the heat home to warm up (yes i ripped it open in the parkinglot to check!!!!! heat blasting of coarse!! shoulda seen the look on the guy parked next to me's face when he saw me pull a snake out of the box lol) i did get straight flipped out on by the postal worker before she gave me the box too. box said keep at room temp, perishable, fragile, this side up and there was holes in the box. all of which might have saved there life but first thing she was uh u know what's in here, (look around to see if i'm bout to get tackled lol) was like yeah, and before i say anything the snapping began, lady was like "there something alive in that box, you can't mail live animals in there " i didn't go to tell her it was 2 pythons lol but i got my box and ran right to the car oooomg i couldn't even go back to sleep once i saw it scanned in richmond! i been up since 4:30 i will post some pics in a little while once they warm up but wooow thanks for all the survival stories over the night to give me hope!! not to mention the prayers and crossed fingers, something worked cause they are alive and look well, now to make sure they stay like that over the next couple of hours after there trip to god knows where when they disapeared for an extra day.

Glad the finally got there and are alive that the great part. I would also let the shipper know you got them and that theywere late and that it could of gotten both in deep trouble shipping that way so he may need to consider a more realible shipping company in the future . I gotten packages later that gone to canada when they were only comping from florida to delaware and be tripping that why I use fedex or UPS (brown suits ) to ship anything important any more.

Where do animals go if they are "confiscated'' by the usps??
I'd like to hear from the shipper on this. This is a matter that he will have to defend--even though there is really no defending the purposeful misshipment of animals.
Shiffy~will you be posting a thread on the BOI?? I think that it's important that instances like these be brought to the full attention of everyone. Blackballing someone who practices these kinds of shipping habits should be the only recourse.
Very happy this turned out OK for you. Will be patiently waiting for pics :gj:
