the only way you could get charged is if its past self defense, dude breaks in, one quick hit to the head with the back, knock him out, and back off...if he gets up or comes towards you hit him again...until he stops attacking or ius unable to try to attack you its self defense...people get in trouble by going to far...one punch or kick while the intruders on the ground bam you get charged....at least thats how i understand the law

my roommate has a bb gun that looks and feels like a real pistol.
maybe you can get one of those..it was like 50 bucks at a sporting goods store

The guy you knew from HS was totally in the wrong and deserved to be charged. The guy with the gun was just protecting himself. And since his car is an extension of his domicile in most states, it would be no different than if HS guy broke through the front door of his house with a bat.

Just sayin'.

If the OP were to protect herself and her family in her domicile with an object that is legal for her to own, she most likely won't be charged either.

I would almost expect her to have a duty to retreat even within her house and to only be legally able to respond to the attacker with equal force IE: fists with fists. I'm referring to anywhere that you have to go "before the Crown".

What has been your worst nieghbor from hell?

It's a tie currently between my old neighbor Natalie and my recent one Francine.

Natalie enjoyed sitting on her patio and cutting her wrists, no joke, and would scream at me "I'm not crazy!"

Francine would wash her car with a broom, wipe her dogs butt whenever he dropped a deuce and sing to him, and would tend to her garden even though she was bleeding through her shirt. She has breast cancer and refuses to ever go to the hospital or see a doctor.

On a good day both women were polite and cordial, at least they were to me anyway.

Actually AZ, that's a real good way to get hurt. Using the threat of deadly force is very serious business. True, you could scare off a bad guy, or you could really tick off a drugged up criminal who could take that BB gun and lodge it in a very uncomfortable orifice.

Is that a Canadian law thing? Here in Virginia, if you are in fear for your life, or for the lives of those under your care, you can use lethal force, even in the face of a lesser armed opponent. When I lived in Florida, as soon as they broke across the threshold of the front door, it was on like Donkey Kong.
