Oh shoot, I thought I mentioned in PM that it looked like an agazizi, the Ca. Desert Tortoise. My guess is someone had it in their yard and it got out, was found by someone else and now you're in charge.
Usually they're darker, but I've seen light ones like that that have been captive raised.

You were right, It's a Gopherus agassizii, When I googled it I used the way you spelt it and that's why nothing came up. I don't know what I am going to do with it now.
