It depends on the make sometimes. Some do get considerably hotter than others.

And the manufacturers get away with it mainly because of all the different temps the different species of reptiles in the hobby require. They are, after all, selling the same product to people who keep cornsnakes, bearded dragons, crested geckos and ball pythons. There is no way a single product can be right for heating all those species. Unless you put it on either a rheostat or a thermostat.

If a single product could do everything correctly then you could equally ask why equipment makes also sell thermostats.
