Wouldn't let one bad experience ruin your plans. Personally this is why I mostly like to go with the big names BHB, royal constrictor designs for instance. You never hear about issues like this and if there are issues they handle them correctly fast.

What to know if it's the norm of the industry to deny refund and blame customers? This is the first time I have deal with something like this. Usually complaints on a forum get a company attention and they try to make right, I have never encounter situation where complaining means I will not get customer service (according to Chris I have lost this right when I started complaining and outing him)

Heck no this is not the norm or by any means acceptable. As a future breeder I will without a doubt take care of my customer first, even if it means that I take a loss. If I was in his shoes I'd refund the customer their money ASAP, apologize profusely for the accidental death, and quite possibly offer a free snake for all the trouble. The good guys in this hobby strive to make their customers happy.
It's not your fault the snake died, it's his, and it should be at his expense not yours. Shipping should of happened as soon as it was safe to ship. Excellent customer service is getting everything geared and boxed up as soon as requested (as long as it's a good shipping day). When I bought my pastel ax girl (from a small time breeder) she was shipped out the day I made payment. My piebald girl (from an even smaller time breeder) was shipped the following day. I've even had Garrick hold onto my silverstreak girl for a few weeks and as soon as I was able to receive her he shipped. This guy your dealing with has been making excuse after excuse.
Honestly stop giving this guy a chance. Get him where it hurts, his wallet. File the police report and start the court process. Scums like this should not get away with this. I don't care if he ends up producing the snake you wanted, his time is long gone for that. If he cared about making it right, he'd come up with that money for a refund. I think it's ridiculous when breeders spend the money they received before the customer gets their snake. That should be no excuse and not your problem either.

Not if you are dealing with someone that is honest. Dont let one scumbag get you down. I know it is a lot of money and it sucks. The biggest problem you will have in court is the waiting so long to file and now you want to wait some more with false hopes that this guy can pull a purple polka dotted unicorn out of his hind end.
I wouldnt wait or do further business with him.
Glad he is up there in Canada and not here in Texas........ he wouldnt be around long here.

This sounds like a bully tactic. I honestly don't understand why you are still even negotiating him. Everyone on here has given you great advice, POST UP ON THE BOI and start the police claim as well as contacting paypal etc. Take screen shots of your emails and post them directly up so its not a battle of hes said this and this. If you feel like taking his work, which at this point has proven to be worth nothing then thats your choice, but I for the life of me can't figure out why you are waiting for his clutch to be born...He doesn't get to dictacte when customer service goes out the window. Absolutely rediculous.

I for one certainly wouldn't be giving him another chance. He won't give you back your money, claims that he "knows" he will get the snake you want (Total lie BTW - it's IMPOSSIBLE to know what you will or won't get from a clutch. He could get all normals even if he breeds two three gene animals together. It's just odds and chance), and has been lying and giving excuses from the get go. You need to stop dealing with him, and take him to court. I wouldn't trust him as far as I could throw him. I wouldn't allow him to bully me into waiting. You ABSOLUTELY have the right to your money back, and the right to take him to court to make him give it back. Stop listening to him, and take his sorry self to court. Hurt him in the wallet - where he is doing his best to hurt you. The difference between him and you? You actually have the right to hurt him in the wallet because he has been doing fraudulent transactions with you. Go talk to a lawyer, and stop talking to Chris.

You should call PayPal for sure. Do it now, will make it slightly more easy on you. Fight him for your money back, don't delay any further. Get your money back and look elsewhere, just don't give up on bp breeding (unless its for boa breeding lol)!!!

If the customer cancels a transaction halfway through a payment plan then it's not unusual for the seller to give a refund less a non-refundable deposit of anywhere from 10-25% of the purchase price. This is usually agreed upon up front or stated in the seller's terms of service or sales agreement.
If the customer demands that the seller ship in unsafe conditions, then understandably the seller should say "No, you need to wait." At that point if the customer demands a refund then the seller is also entitled to the non-refundable deposit.
However, if the customer has paid in full, waited for safe shipping weather and the seller's convenience for receipt of the snake, and the seller can no longer provide the snake, then there is no reason not to expect a full refund.

Paypal doesn't provide buyer protection with live animals. Also the 45 days is way past up. If she had paid with a credit card through paypal she'd be able to maybe dispute with the credit card company.
