I agree. I love using my own animals. My banner is made from my pied with my logo over the top. I love it when people that have never seen a pied ask if it's a real snake.

    Re: Website Design Picture

Keep in mind as well, that the people that would actually see this thread and the picture you're asking about is a TINY TINY fraction of the snake owners and photographers out there. Just because no one here would recognize that picture wouldn't mean it doesn't belong to someone.

The ONLY way to use someone else's picture is to KNOW who it belongs to and receive their written consent to do so...or buy the rights to a picture off a stock photo website.

I'm glad you realize this and are not going to use it. I'm just reiterating the facts a bit because there are a LOT of people out there who think so little of using other people's work.

EDIT for PS: I also moved this to the Business Talk forum. It's not a good idea to use the wrong forum just to try and increase the views on a particular thread.

Yes and No, car dealerships put cars they would never get on their site, to add some eye candy. there is nothing wrong about it.

For the most part pictures on the net are fine to use on your site along as they are not copy written.

always remember you are a small fish and nobody will go after you for infringement, however always keep this in the back of your head. look what happened to YouTube, Google, FaceBook, they all started small and grown into multi billion companies. if there was a picture on the site that was from someone else then I would expect a law suite because it would be worth it now.

so to protect you I would go to your local zoo or reptile store and ask them if you can take some pictures of there animals to put on your site, tell them you will put a link to there store/zoo for credits.

You are very wrong in these assumptions. If you didn't take the picture and you do not have permission from the person who owns the picture, then you are stealing. Most websites have copy write language, but their pics may not have a logo or a copy write mark.

After you have spent hours and hours trying to get the right picture with the right background, lighting and pose on a live animal you may understand that a picture is a personal expression and possession of the person who took it. If you do not have permission to use it, then you are stealing someone else's work.

As for infringement, start using a name brand on your site and see how fast the legal department of the company who owns the trademark comes after you. Small fish or not, companies will vigirously defend their trademarks.

Stealing is stealing just because someone doesn't notice doesn't make it right.

I don't think there's anything wrong with using a picture of an animal you don't actually own (so long as you own rights to the picture itself) however, it should at least be a species and morph you are currently working with. It can make a BAD first impression if someone comes to your site expecting to be able to find green tree pythons or a mystic potion ball python because you have one in your logo...only to find out nothing of the sort is available.

This is an attitude about stealing internet pictures that gets to me every time I see it. Just because a picture doesn't carry a specific watermark does NOT mean it's up for grabs to anyone who wishes to use it.

That's a dangerous assumption to make. Steal the wrong person's picture and they won't care how big your wallet is, they will go after you hard just on principle. Seen it happen many, many times for many different reasons. "Small fish" are absolutely not exempt from legal action just because there may be no money to fish out of that pond.

Also...and far more important...is your REPUTATION is on the line. Your logo is your face to the public. One of the fastest ways to trash your reputation before even getting out of the starting gate is to get called out in public for using someone else's picture without their permission. That can and will happen fast and furious in the Internet shark tank. Take some time to cruise through threads on the BOI if you doubt that.
