    Lacy Act Addition of 201 Species

    Here we go 201 species of Salamanders are being added effective 15 days from yesterday (01/13/2016) -

    To say this is an overstep by FWS is a gross understatement. This is a straight up misuse and abuse of existing laws to benefit their agendas. NOW, that is not to say that the battle they are fighting is not in need of addressing (The fungus among us is real). But, the justification they are using to add this amount of species to the lacy act is outrages.

    In better news and hopeful news. USARK has a new witness in testimony against the Lacy act banning interstate transport of animals on the list. The Lacy Act, for all intents and purpose, is not capable of prohibiting movement of animals already in the country, across state lines. It is only meant to block them from being imported from outside of the country, or moved to the two outliers, Alaska and Hawaii. While this is great news for our lawsuit and looks extremely promising that regardless of what happens, we will one day soon be able to ship, and transport ALL Lacy act Species across state lines without fear of becoming a felon once again. This includes BURMESE PYTHONS, ALL SPECIES OF ANACONDA, AFRICAN ROCK PYTHON, INDIAN PYTHON, RETICULATED PYTHONS. This will be a HUGE win for the breeding industry, and make a lot of folks comfortable breeding again to push our development of gene mixes further.

    Below is an excerpt from our brief:

    "For instance, in 1974, a FWS representative testified before the House Committee on a then-ongoing FWS Lacey Act rulemaking:

    Mr. DINGELL. Now, what about the problem of exotic species that are already in this country?… I have read these new rèsumès, and I do not find that you address yourself very extensively to populations of these which are already existent inside the United States….

    Mr. PARSONS. As far as the regulatory aspects of your question, there is no restriction that we find in section 42 of the Lacey Act to interstate shipments, with the possible exception of restrictions from areas off the continental United States, such as Puerto Rico, the Virgin Islands, and Hawaii…. The restrictions, Mr. Chairman, apply to importations.

    Mr. DINGELL. How about the offspring of these populations in this country?

    Mr. PARSONS. The offspring of those populations that are here would be treated likewise.

    Mr. DINGELL. You are going to treat these as essentially a separate strain, as some kind of domesticated species?

    Mr. PARSONS. That is right. The restrictions apply to imported animals and their offspring, and not to animals already in the United States."
