Please Help Me!
Hey guys and girls...
Last week, I ordered a " Proven Female Fire ". I paid 1,300$ for her. Well She came in Friday, and I was gone on business, so my girlfriend, unpacked her, and put her up for me. Well, I came back this morning, and excitedly looked at her. And she is 100000% NOT a fire. There is nothing fire about her. I emailed the guy back, and told him ( nicely ). That there may have been a mixup because the female I got is def not a fire. Well, he responded " No mixup, she may not be a fire, I was just told she was..."
My question is, is there anything I can do legally? To get my money back or something? or do I just have to suck it up, and take it as a loss and learn not to just trust people anymore. I really want to take some kind of action, but I dont know.. PLEASE help me

You may just have to suck it up. You might be able to do something in civil court, but it probably wouldn't be worth the cost.
BTW, did you see a pic of the snake before you bought it?

Can you post a copy of the ad and pictures of the snake? I'd demand a refund, and probably post all the info about the seller and the sale on the BOI and on the inquiry section here. That sucks, and is a very shady thing to do if it was sold as a proven fire.

I bought it from a guy named Donald Day. It was a Hoobly.com ad, which is now deleted. and, Thats another thing Xdeus, I did see a pic.. and the pic I saw was a fire, a beautiful fire.. but the snake I got and the snake in the picture are 2 totally different snakes.. totally different patterns, colors, etc.

Unfortuneately, that might be your only recourse if the guy refuses to give you a refund. It sounds like he just plain scammed you, so I doubt he will be very responsive. I'd give him one chance to make it right, then post all of the info all over the forums and make a complaint to the website he advertised on. Then, next time you are on vacation in Virginia, pay him a warm visit.

yeah id take it to the Boi and also when u get to Fauna do a search for that site i think someone else over there got scammed from a seller on the hooobly site(spelling) id say post all pictures and emails you got from and to this guy on the board of inquiries on fauna just to have a record on a public forum so others can see

Man that stinks!! I would probably get sick to my stomach. Hope you get this resolved. Be sure to do your best to out this jerk so no one else gets scammed.

eek. stinky situation. Is it possible find out who he purchased this animal from and who told him it was a fire? I agree, the BOI is another great resource to post these kinds of situations up. Keep us posted.

I would honestly call the local police once you get to his house and get things resolved.
Getting your 1300 back is way worth a night in jail!!!!

In addition to everything above you can file a dispute with you're credit card company. Sounds like you got scammed though; anyone respectable would not sell an animal as a genetic trait just because they were "told" it was something.
Shady business, knowing who you're buying from next time is your best defense. The BOI is a great tool; its a shame most people don't use it until after they've been burned.

You beat me to it. I strongly suggest you dispute it with your credit card company.

If he posted a pic of the animal for sale, and sent you a different animal, then it's fraud. Tell him so, show him a pic of the animal you recieved with the pic he had in the ad, and point out definite differences. Tell him it is fraud, and you want this situation resolved IMMEDIATELY.
Try to sound professional but firm, without calling a bunch of names and not threatening the guy.
If you threaten to go beat him up, that's call for HIM to legimately call the cops on YOU.
If he refuses to make it right, go to the BOI, and post it in full.

Unfortunately I have seen this happen many times.
It is so important to do your homework and research someone before you do a transaction.
When a deal is too good to be true, it usually is. That was a very low price for a proven fire.
I knew someone who paid for a ball morph(great price!) and got a corn!
Going to the BOI is good to alert others but the reality is you should have started there in the first place and it could have saved you some grief.
I am not blaming you so please dont take it that way, I am just saying that you learned the hard way.
I also got a misrepresented animal when I first started buying morphs, mine was a sex mistake. I learned too deal with people with positive reputations and do the same and you will be better off.
Sorry this happened to you, but unfortunately there are alot of these kinda people out there.
Hope you can resolve this in a positive manner.

As many are saying, if you paid with a credit card, just report the fraud to your CC company and they'll remove the charge.

Looks like a deliberate scam to me. There was recently a scam thread on the BOI where somebody saw an albino bp advertised on hoobly.com at a too good to be true price. The seller insisted on a money order which the buyer sent and received nothing in return. I remember that the seller was near Lancaster Pa. Hopefully you used a credit card. If you did, place this sale in dispute with the credit card issuer. If you used a check or money order you are probably out of luck. hoobly.com sounds like a place to avoid. Good luck to you.

I would call the cc company if you paid by cc, if not i would go to him personaly no matter how far and pretty much make him give me my money back for the snake.:fork::devilish:

Well, Unfortunately the snake was bought with paypal, and funds have already cleared.. I read somewhere that when buying with paypal, you can't dispute items like live animals, etc.. :mad:

I would still try to fight it, give the cc company a call, if it was false advertising you will get your money back, i challanged paypal with a purchased and they returned my money go to the paypal site and go to disputes it takes a little time but they will help and say you just want to rturn the item it was not as advertised.:rage:

If they took money right out of your bank account, you are screwed. But if you charged it on a credit card through Paypal you can still place it in dispute with the credit card issuer and leave Paypal out of it. I have done that.

Ditto that.
Don't shy away from posting this on the Board of Inquiry at Fauna. It IS a great resource, even if you don't get the best of results at the end of your case, many others will know about this seller and hopefully put him out of business if he is truly out there scamming unsuspecting folks.

How did you pay? Paypal or Credit card companies can reverse the payment. Also, if he has any kind of legit business, contact the BBB, I got scammed online, and contacted the BBB and got a check in the mail from the scammer the next week. You could also contact the local authorities, and at least file a report, so if it happens to someone else, at least there is a documented history, or if you could find out if he scammed other people, you could make it a civil case and share the expenses. Those are all the suggestions I can think of, good luck.
I'm sorry I reread and saw you used paypal, if you can prove a false ad, then it shouldn't matter if it was a live animal. Show what was sent, and the pictures from the ad, paypal can probably help.

If the money was taken out of your bank account using your ATM Debit card I believe you could still be protected by your banks Internet Purchase Protection Program.
Exhaust all your resources and don't resort to going to the guys house to get your money back. If he's willing to blatantly rip you off who knows what else his pathetic soul is willing to do. Desperate people do desperate things.
I agree that you should report him to the BOI and any where else you think he might try to pull another fast one.
Good luck to you and I hope it all works out for the best but if not just considerate it a very expensive life lesson. Sorry it happened to you! :(

Go to Paypal Resolution Center,open a dispute and communicate with the seller through there.If nothing comes out of it,escalade it to a claim and Paypal will investigate and retrieve your money if possible.It may take a little time but its worked for me.(Don't know about the live animal thing you mention) OR go on a road trip and .......

Yea, they mentioned on the BOI that he probably posted on here to see what the people he was scamming could do. What a scumbag.
