    We're OK, but had a car accident..
    Just got in.. Mark and I were going into town with our '00 Pathfinder (he was driving, I in front passenger..) with our ATV on a trailer behind us, going to get some propane.. we were just going along at the 55 mph speed limit. well, on a side road where They had a stop sign, this woman rolls right through it.. plows right into us. I could see the whole thing and keep playing it over in my head; the crash itself was terrifying but the two of us are OK. Our truck is totaled in front (they'd better not claim to be able to fix it, meaning her insurance) and out ATV broke its lashes and flew off the trailer, landing on its top in the middle of the road; Mark jumped out and flipped it rightside up and pushed it over so no more crashes would happen.. her car was pretty banged up; richoceted off our front end/left quarterpanel and landed in a ditch at an angle, but her and her apssenger were not critically injured, though ambulances took them.
    This other driver, was this old woman who HAD to have seen us; I mean, how do you miss a huge SUV rolling along at 55 mph with a huge trailer and a big ATV on it!? You know how sometimes you casually roll through stopsigne when it is clear as day on both sides.. well, please don't do it like she did, when an SUV is cruising along at you.
    I am still pretty shaken up; dropped off at home by Mark's cousin and I let the horses in, ate some meatloaf and well I really need to type this stuff out. Please everyone, drive carefully, but more importantly look out for the moronic idiots who aren't.
    And please wear seatbelts; we would both be dead or shattered if we weren't; the airbags didn't deploy.

    sheesh ya just never know when it's gonna happen. Glad to hear everyone is OK. I am sure it could have been worse..

    Oh my! First off I'm glad you both are okay, thankfully wearing your seatbelts because material things like the truck and SUV can be replaced, you two cannot. Secondly, I almost had the same thing happen to me the other day, but I saw the person was going to keep going and honked like mad. I swear some people shouldn't be allowed to drive.

    Rest up, I'm sure you'll be a little sore tomorrow.

    Tha;'s the crazy thing! Mark laid on the horn, seeing that this woman was going to keep going. If he hadn't slowed down as much, they would have t-boned right into the side of our truck instead of bouncing off the front end.. and they would have been killed probably.
    I guess the woman was 85 years old-ish.

    Wow i am glad everyone is ok.Do not be shocked if she tries to blame you for not giving her the right of way :irkd: .I think i would have something done about the defective air bags also,with a crash like your describing they should have been out.

    I dont' think so. Standard front-end airbags only deploy (usually) in a full head-on collision. Had the woman pulled out directly in front of them, forcing them to t-bone her...then the air bags should have gone off. But if the car gets struck from the side, even the side of the front end, they usually won't.

    Sorry to hear about the accident, but I'm glad to hear no one was seriously injured, especially with a crash at such a high speed. I hope everything goes smoothly with the insurance claims.

    Wow Jen, glad you are ok! I think DMV needs to get more aggressive and force senior citizens to be retested often. There are way too many dangerous drivers out there who can no longer see over the wheel.

    Well i hit a pole awhile back to avoid hiting a mentally challenged guy and my air bags never released.I hit the pole at a angle on the right side of the bumper.When i took it to get a estimant(spelling) they included replacing the defective air bag component.I was driving a 2003 chevy silverado at the time,maybe some vehicles are differant:confused: .So that is why i mentioned it just in case.

    Thanks everyone. I am just hoping that their insurance covers our quad; it was on the trailer, and I was told by the sheriff that any "cargo" on the trailer would be covered too; anyone know about this? we still owe 5k on the thing.. and we need it for normal life at home (taking the horsey manure out every day, etc.)

    All auto insurance is different. Odds are it will be covered but there is some crappy insurance out there.

    So sorry you and Mark were involved in this accident, but thank God you are both okay Jen. It could have been so much worse! I agree with Jamie that older drivers really do need to be retested a bit more often. Many are beyond a safe driving age but find it hard to realize that themselves and give up that driving privilege voluntarily. I hope the insurance companies don't play any games with you. Did you get good clear pics of any and all damages? Also if you or Mark start to feel any after affects of the accident do get it documented by a physician (insurance companies do not like to pay out on claims though they sure as heck love collecting those premiums!)

    Thanks; I am more than anything, glad that mark and I are OK. The only thing wrong with me, is I bit the side of my tongue and it swelled up a little but it is better this morning than it was yesterday. Just a little achy, like Mark is, nothing serious.
    I am really scared about our ATV; our insurance said they will not cover it, just the car and trailer. And we can't find any info about her insurance till tomorrow; this is such a hassle. Gotta borrow a truck from our landlord; the rental is only covered up to $30 and it'd be about double that for us to get a truck, that he needs for work stuff.
    Grrrrr. I hate cars and driving; I wish I could just be a city person and walk everywhere, but it's in my blood to be out here. Sigh..

    The truck; the frame is twisted/split halfway or more down the drivers side; the rear driver's wheel spins at an angle, and both drivers side doors won't close right. :)

    Pics of my poor quad, The Frog.. I swear this thing is like a part of me. Everytime I am upset about work, mad at someone, etc. we go off into the woods together; I am going to miss him. He actually still starts and runs, and can possibly be salvaged, but we hope to just get a new one out of all this. The quad landed on its topside and Mark had to flip it over and roll it out of the road! It was horrific, looking out my car window to see this thing hurtling over itself like it did.. luckily no one was in that oncoming lane.. we had it strapped to the trailer firmly; the impact just destroyed the straps. RIP Frog.

    Your insurance company will not be the ones replacing your vehicle and ATV it will be here insurance company.I think you need to speak to someone higher up in your insurance company,i think your agent is confused possibly.Point blank she run the stop sign and she hit you its her fault 100% so she pays for everything.

    Oh I just dislike insurance companies on principle. Years ago I worked for a personal lines insurance carrier and I swear if they could wriggle out of paying a claim or get the policy holder to take less they were thrilled! Darn them! Jen, don't let them feed you any lines or give you less than you deserve in compensation for your loss of the vehicle and the ATV. If all else fails start mumbling about a lawyer to protect your interests. Insurance companies hate lawyers and sometimes it takes the threat of a really ticked off person going to see a lawyer to get their butts in gear and get a check cut. Some of them simply think if they drag the claim out you'll just eventually take less rather than wait or see how they can lay some of the blame on you and lessen the liability. Don't let them start those games kiddo.

    If her insurance balks at paying for the quad, you should sue the driver for it instead. While you may not get full replacement costs for a brand-new quad, they are required to "make you whole" for ALL the damage they caused, not just to the car.

    I am just physically exhausted today; no pain and mark feels OK. I am just thinking, should we just get a lawyer off the bat? i heard from someone that just talking to their insurance person could make us lose out.. we were told that we can't talk to them till tomorrow due to the holiday.
    I sincerely thank ya's for the good thoughts and help; it is helpful just to type this out and know that you's care :)
