New York State Assembly Bill 2869 - Introduced January 18, 2013
On January 18, 2013, Assemblywoman Barbara M. Clark (D-Queens Village) introduced Assembly Bill 2869 which was referred to Agriculture the same day. A2869 seeks to criminalize all ownership of wild animals or reptiles “capable of inflicting bodily harm upon a human” as a felony.
http://herpalliance.com/2013/02/03/n...ile-ownership/
370. PROHIBITION OF THE OWNERSHIP, POSSESSION OR HARBORING OF wild animals and reptiles. Any person owning, possessing or harboring a wild animal or reptile capable of inflicting bodily harm upon a human being is guilty of a CLASS E FELONY AS DEFINED BY THE PENAL LAW.
-
A horse nearly fractured my femur once when I was 10, we should make owning them a felony too. Just think of it, bodily harm to children is possible!
Letter writing time!

This isn't cool. One more reason to move to PA.

This stuff just moves from state to state. Our politicians have this idea that they know how everyone should breathe, eat, sleep and live. I'm sick of it.
-
When I was a kid, I had a cat bite my thumb and break the nail down in the quick.
BAN CATS!
-
Lets redefine 'Bodily harm'.
-
Any animal can cause bodily harm... I highly doubt it will pass but wow. That's incredibly ridiculous.

Re: New York State Assembly Bill 2869 - Introduced January 18, 2013
We have already been in touch with the sponsoring Assemblywoman's office, and they are quick to acknowledge that the current wording is very unclear, and said that they are already working on a revised proposal. They claim that they are not looking to increase the number of species beyond what is already restricted in NY, but rather increase the penalties on those with illegal animals, or where the public is actually harmed. The terrible incident in CT with the chimp a couple of years back seems to be what they are zeroing in on. It is not close to being voted on formally yet, as it would have to go through multiple committees first (currently under review by Agriculture, where other forms of this bill have died over the past few years).
This is bill certainly should be monitored closely, but I am hopeful that the end result will not effect most herpers here in NY. When I hear more, I will update.

Not that I'm happy with the reptiles currently banned but I'm so happy to hear this isn't going to go after other species. Still will be waiting to see how this plays out before I start a rack full of carpets

This will be a big change right now if you own them the DEC will just take them and might have to pay a fine. A class e felony is punishable by 2-5 years in prison.

The impression I got was that they are looking to increase the penalties if you have one of the restricted species without a permit. Hopefully, the language in the new version will make clearer exactly what they are trying to do. At some point it may well be worth targeting the members of the state Agriculture Committee with calls/emails regarding this when they are getting ready to review the law, but it may be premature now to act until we can see what the final version will be that they will be reviewing.

Prediction - and you heard it here first:
When the assemblywoman's office clears up the acknowledged vague wording (on their own) - a certain grandstanding group will claim this as a legislative victory.
Wait and see.

Wording or not this is BS. Its lazy crap! These guys should be working on fixing why minimum wage and education sucks.
Its a BS excuse to get attention and votes.
I wrote to several assembly men/woman already.
I walked to streets of Iraq and these :cens0r::cens0r::cens0r::cens0r::cens0r::cens0r:s want to make me a felon????
Come over to my house and spit in my face too.
If some idiot wants to own a monkey then let them, eventually the monkey will off the idiot from the gene pool.
Obviously some animals shouldnt be owned like a lion or bear or primate that is 5x's as strong as a grown man...freaking duh
It makes me too mad...how the heck does someone decide to start a law like this when statistics and the internet is available.

That's a response I've received today... to my Grass Email with I've send thru USARK page...
Dear Rafal,
Thank you for your email regarding A. 2869. It is important that I know
your thoughts and concerns about legislation that will come before the
Assembly Agriculture Committee.
I have been in touch with Assemblyman’s Magee’s office and do not believe
that this legislation will be on the next committee agenda.
I will be sure to keep your concerns in mind should this legislation be put
on a future agenda.
Sincerely,
Aileen Gunther
Member of Assembly

I hit my face with a hammer once.
We should totally ban them. Imagine then how much safer the country will be thanks to the politicians!
I probably lost a pint of blood due to hamster bites too. (No joke!) Imagine then how our children will be safer once we eradicate all those damn hamsters!
:salute:

I've lost more blood to mosquitoes...

Re: New York State Assembly Bill 2869 - Introduced January 18, 2013
I'm almost sure this woman has a fear of snakes, or maybe even reptiles in general. It's sad because she has probably never had a personal encounter with a captive, docile reptile. It's time for phone calls, letters, and e-mails for me :D.
-
if only these reptiles would REALLY be dangerous.... Then we could use the tactic gun-lovers use so effectively. Just threaten to use your reptiles against those that come to take them away from you :D
-
Does this include Ball pythons? I live in ny and actively looking to buy one.
Of course a law doesn't faze me, but still.
