Nick Fiore! Scammer???

Has anyone done, or currently doing business with this guy? He is in Florida. Long story short, he was suppose to send out a female Pastave that I paid for on January 4th, he has yet to send her out and has been lying and making excuses the entire time. I am sick and tired of him playing his games.

Nothing under that name on the boi that I can see.

Did you file a PayPal dispute?

Sounds like you got burned... Ouch :( If you paid through paypal, file a dispute.

This is why I only deal with people who have positive feedback.

Here are the details everyone, sorry it took so long.


I send out a money order because that is what he asked for specifically
Since he did not have a pay pal account.

We mailed it to him on December 24.
We even sent him a picture of it to confirm.
Thanks to the holidays, it takes a little longer to get there so he received it on January 3rd.

He then tells me that he is on his way to underground reptiles because that is who he is shipping through.
A few minutes later he tells me that the guys there said they cannot ship her because she was about to shed and it would cause extra stress on her. Which I could understand, so I oblique and wait a few days.

After days and days of getting "oh no she hasn't shed, ill soak her".
Finally on the morning of January 9th i text him asking if she has shed and he says yes.
I then ask him, "so I should be receiving her tomorrow?"

He tells me:"Yea I'm going to be there at 11 and get you the tracking number "
Me: Awesome! Ill look forward to your text :)! Thanks again

January 10th

8:12am

Nick:"Hey I'm receiving a payment for another snake today so when I go to pick it up I'm going to ship both but this payment should clear sometime today before 12"

Me: Ok.. Thank you

12:09pm

Me: Did it clear already?

Nick: "I'm still waiting I have until 5 to get there "

Me: "Ok, I know it seems weird but can you just promise me you will get there ? My wife if trippin :/ and on my ass about it . . My bad"

Nick:"Yea I hear you I'm just trying to save myself some money with the shipping"

Me:" Hey Nick"

4:36pm
Me:" Really hope you got her there"

January 11

8:00am
Me:" I really need to know if you shipped Nick"

8:50am
Me:"Please let me know something anything Nick!!! You promised me you would make it there yesterday. "

I then call FedEx headquarters and see if there is anything coming overnight to my address. The lady tells me there is nothing.

I was furious!I then tell him a few colorful words and give him a warning that i will post on this forum about our situation and his reputation will be at steak.

Nick:" Hey sorry I just got my phone back it was in my friends car and it had died I havnt had it since yesterday and after looking at all the weather and everything because I can't just worry about your state it's all the states in between she will be arriving on Tuesday between 2-4 she will be shipped out on Monday "

January 13th

Me:"Tomorrow's the day"!! :)

Nick:"Yep lol"

Nick: "Hey as soon as I get over there ill send you the tracking number"

Me: "Ok, Thanks

Me:"Tracking Number? "

Nick:"Yea I have a tracking number working the night shift get to you soon"

I then call underground reptiles and they say they haven't received anything.

Me: "Your Lying , I just called underground reptiles they haven't received anything." Not unless you decided to ship with FedEx after all


Then he sends me this picture at 6:01pm
And a text that says "Im sorry I'm fixing it"

Immediately I respond:
"You left it up to your little brother? What is going on? This is ridiculous"

I then tell him that I am not afraid to press charges on him if he continues to jerk us around.

He offers me my money back. But god knows how long that would take, or if he even has it.
I tell him , I'd like the snake that we had originally agreed on.

Nick:"I just got home my brother didnt do it I am off tomorrow and will get t done"

Me:"Will you do it first thing in the morning ?"

Nick:"Yes,I was supost to ship 2 out today so your not the only one mad at me"

January 15th

Me:"Tracking number?"

3:10pm
Me:"Will you respond to me. Please update me on what's going on.. Do you not have money to ship them or what???"

Nick:"Im here now"

Me: "Please let me know once you are done and have the tracking number"

Nick:"Your temp tonight are going to be 29 do you want me to ship?"

Me:"I want them to hold the snake. "

I then take the time to call Underground Reptiles to make sure he is in the store and not lying to me

The man tells me, no, no one has gone in to ship out a snake.

He then asked me about me situation and how he could help.

BIG A+ on customer services guys!!

(Oh yeah,) he also tells me that they would not postpone a shipping because of shedding and that they never have!!!

Me: "I know you are not there I am on the phone with underground! Stop lying to me nick I'm sick of this bs! I've been nothing but kind to you."

After BLOWING UP his phone, He finally answers and tells me that underground reptiles had like 20 people there and he didnt feel like standing in line. So he went to Ben "?" Reptiles, which is supposedly right up the street from them.

On the phone:
Me: So did you drop her off and ship her?"

Nick: "No, they wanted to charge me $5 a day to board until they can ship.

Me: I WILL PAY FOR IT! Just get her there!

Nick:"Oh ok, in that case it's no problem."

Me: "So your going back right now?"

Nick: "Yeah"

Me: " Text me as soon as you get there."

Nick:"Ok"

We say bye and hang up

I then call this "Ben ___ something reptiles shop, and they said,

"Yes he came in there and wanted to ship two snakes but he thought it was cheaper. He also told me boarding is only $2 a day." I thanked him and asked him If he would mind giving me a call when he showed up so we could confirm payment for boarding.

It is now 5:22pm and still no reply from Nick or either shop.

Probably ben siegal's shop. Down in south Florida. I know it seems like he's screwing you, but he's still conversing with you so that is actually a good sign. He offered to send the money back, which is also a good sign.

Before you have a coronary, take a deep breath. I know its frustrating waiting for a shipment, and hopefully he pulls through.

I'm not saying he's doing good business, but I wouldn't write him up as a scammer just yet.

If it makes you feel any better, I've been waiting for my ybs (paid with money order too) since December 17ish. Cold weather sucks :-( but I have faith in the guy.

I know, I completely understand and I would be pretty hot under the collar too. But right now, getting upset isn't going to solve anything. You don't want to make him NOT want to ship it, just to "show you" for being a jerk. Rather, try and be calm and collected, but serious as a heart attack. Let him know you understand things get confused sometimes, or things come up, yea working the night shift is a pain in the ass, etc etc but also that you will inform your lawyer of the possibility of coming after him. For instance, you could say "Hey Nick, I know I got a little hot with you, and I'm sorry for that. I know things can and do come up, but I believe I've waited long enough for my snakes. I'll tell you what, I'll give you until Friday the 25th. If I haven't received my snakes, I will let my lawyer know to move forward with legal action. I appreciate your understanding in this matter, and I hope to be able to put this all behind us without issue."

Or whatever date you feel like, but give him enough time to actually make good on it (IE: don't make the date tomorrow :P) Check the weather forecast for the route from south florida to your place, just to make sure your shipment isn't trudging through any snow storms etc, and let him know you're ok with shipping with current weather conditions, to be held at hub for pick up etc.

I hope this ends well for you, and you get your snakes. If he doesn't follow through with the shipment, make sure to also make a BOI post on fauna classifieds with this incident + his bp.net name and full name. Possibly even address and phone number as well.

So even after apologizing, nick has still not contacted me about our snake.. Is there really no way to resolve this? All I can do is write a bad review on him? I know some of you can afford to buy banana's but $500 dollars is ALOT of money to me!

Any amount of money is a big deal when you are out of it.

Communication is key in any business especially when a payment is made.

Yes things can happen, delays due to personal life or weather can happen however with good communication it should not be a problem.

Now if the seller fails to fulfill his obligations and is not communicating you are entitle to cancel this transaction and get a full refund.

Give him a last ultimatum: You get your money back by the end of today or you file a complaint with whoever issued the money order and post on the BOI.

He either refund your money or comes up with some excuses which in case you can still demand to get your money back TODAY.

But I did not go through PayPal..?? And yes that is exactly what it is..! He has failed to fulfill his obligations. Payment was made January 3rd.

You can also post on that BBB website if the guy has a business....I'd personally talk to a lawyer too...depending on state laws even oral agreements can be considered legally binding in some states and you have emails/texts? back and forth?

He has not been active on this site since the 27th of December 2012 and, currently, his ability to post new ads has been suspended until this is resolved.

his ad remains up so that you can link to it on the BOI if you feel it will help.

Take your time and lay out ALL the info in the BOI thread - even if it makes you look impatient or rude. The truth will come out so it is always best to be up front with everything right from the start and get the timelines and all communication laid out in a clear and accurate manner.

Contest the money order, I believe you still have time to do so if I recall you have 30 days.

I would also tell him you're going to let both those shops know he's screwing you over too. Diplomatically, not just say "Dude, I'm telling those shops you screwed me over".

Sorry about the whole situation and I hope you get it resolved.

I know this may seem like "DUH!" but make sure you make copies of EVERYTHING pertaining to this issue....save EVERYTHING...any voice mails, emails, texts, if you speak via phone make a written record of it...date/time/length of call/incoming phone #'s....and (im more paranoid/ocd then most) but I also make a 2nd copy of everything and give it to someone I trust with my life for safe keeping.

All of this helps a lot if it ever gets to the point where lawyers/legal systems are involved.

Even if it doesnt its good to have records of all this sort of stuff...especially if your going to post up on BOI on fauna

Thanks so much for all your help! I might take you up on that offer. He said he lived in boca raton fl 33433, that is where I sent the money order too. Then all of a sudden when he was about to ship the snake. He said, " I only live about 10 minutes away from underground. Which is 3 hours away from Boca raton!!

I have no idea either, the best would be for you to contact the people who issued the MO and see what the resources are if any.

In reading the ad that you posted the link to, it sounds like this is just a guy trying to sell a few snakes he has because he needs cash right now. If that's the case, does it make sense to take your time to file complaints and post poor feedback, etc, on as many reptile sites as you can? If he's not a breeder or someone that is likely going to be "doing business" regularly or in the near future, it seems like an exercise in futility to spend any time focusing on anything but getting your snake/refund.

Maybe there's something in there that makes it obvious that I'm wrong. I just don't know anything at all about the business of end of all of this. To me, this basically looks like a Craigslist-type transaction.
