    Breeding Loan Contract
I've seen a few posts where someone was going to make out a basic breeding loan contract.....did anyone ever do it? :P

I should be acquiring someone's pastel female to breed with my pastel male shortly and would like a contract. I have the basic guidelines but if someone made a general one up already I'd be interested in looking it over to make sure I don't miss anything.

    Thanks. :)

I have one I wrote a while back, and I know a lot of people are using it as a basis.

I will check and see if I have it on my other computer.

    Re: Breeding Loan Contract
_(Y)_ agrees to lend their __Morph___ ball python to _(X)_ for breeding purposes from (Insert Date Here) until such time as the breeding season is over, but no later than (Insert Date Here) if the snakes do not produce.
    (Y) is responsible for the transportation (thru UPS, Fedex, or Delta Dash overnight) of their snake to the residence of (X) in an appropriately heated and controlled box and environment, and (X) is likewise financially responsible for the transportation of the ___Morph Ball Python___ back to (Y)'s residence in an appropriately heated and controlled box and environment (thru UPS, Fedex, or Delta Dash overnight).
If said snakes are received upon shipping as dead on arrival, either party must notify the other immediately within 24 hours. Either party must provide proof of the dead snake and send it back to the owner as soon as possible. A necropsy must be done to determine the mode of death, and if the fault falls on either party after the necropsy, said party will be held accountable.
    (X) shall feed and house said animals in the appropriate fashion, and will send pictures and update (Y) on a frequent basis as to the health and housing of the snakes. (X) agrees not to replace or steal said snakes, or intentionally harm or intentionally create an environment where said snakes will become ill.
If the female snakes, belonging to (X), do become gravid and produce eggs, this shall be properly documented and photographed to send to (Y) immediately. The eggs shall be handled properly and if said eggs hatch, the share of the clutch is as follows: the clutch will be split evenly by sex and by morph, unless such time as there is an uneven amount of eggs, by which (Y) will acquire the final odd hatchling. At no point will there be an uneven share of the hatchlings unless discussed and agreed upon.
Every snake shall be documented and sexed accordingly, and be fed and cared for until which time as the hatchlings achieve a minimum weight of 100 grams. At that time and not before shall the hatchlings be sent to (Y). If at this time the ___Morph Ball Python_____ is not sent back, they can all be sent back together with the hatchlings in the appropriate boxes. This contract will terminate when the duties described above have been completed.

    Thanks!

One last question.....since this will be a pastel/pastel mating, what kind of wording should go into the contract regarding the possibility of super babies? IE: if we would happen to get one super pastel, what would be the best way to decide who gets it?

personally the one with the higher value snake should get the first option/pick but you could sell it and split the $ or you could even figure the pricing of the clutch and split the babies up by that

    Re: Breeding Loan Contract
Here's the one that Ed and I have used and I now use as a standard breeding loan with others:

    Quote:

Wildmorph Pythons LLC will on the agreed upon date of ___________________________ take in to its breeding collection __________ female ball python(s) of proper weight (1500 grams or greater) and of good health. The animal will be quarantined for no less than 60 days. Quarantine will included total isolation from the rest of the breeding or sale collection, a strict sanitizing procedure for all persons/equipment/Misc that come in contact with the above animal or related environment will be observed through out the quarantine period.

Care of the animal which includes but is not limited to; enclosure, bedding, hydration, medical, temperature and humidity control and monitoring will be the sole responsibility both in terms of financial and labor of Wildmorph Pythons LLC. Although we don't expect any problems, if at any time a health issue arises the owner will be contacted and consulted as to the course of medical treatment/action that they wish to pursue. If at anytime Wildmorph Pythons feels that breeding or any other unforeseen situation will endanger the health or well being of either the loaned animal or of its own collection, Wildmorph Pythons reserves the right to terminate breeding attempts and schedule a convenient time to have the animal returned to its owner.

Understand that some complications can arise any time breeding of any animal is pursued. We do no expect any complications but are fully prepared to do what is necessary to insure the health and well being of your animal and that of our collection is maintained. Should for any reason the loaned animal die as a result of actions or lack of action on the behalf of Wildmorph Pythons the agreed amount of ______________ USD will be paid as restitution to the stated owner within a period of no more than 60 business days.

Feeding of the above said animal is the sole responsibility of Wildmorph Pythons. Feeders of appropriate size and sate (Live/FT/PK) will be offered every week until such time as the animal is no longer in the care of Wildmorph Pythons. Records of feeding including state and acceptance record will be kept for the time your animal is in our care.

The morphed offspring will be divided between Wildmorph Pythons and (Robin Abernethy)_______________________________________________ as follows. Selection of offspring will be made in person after such time as they are deemed healthy and ready for transport by Wildmorph Pythons. This includes but is not limited to having begun and established a feeding schedule of once every 7 days. The offspring must have accepted no less than four consecutive meals and have shed twice. At such time the owner of the loaned animal (Robin Abernethy) will be given first choice of the offspring regardless of sex and alternate between selection with Wildmorph Pythons LLC. If an odd number of morphed offspring are born the owner of the loaned animal (Robin Abernethy) will be given the larger number of them. Any non-morphed offspring will be divided as above unless other wise verbally agreed other wise.

All offspring will have their sex verified by an outside nonaffiliated person (Sean Brantley; owner/operator of Exotics by Nature LLC). All offspring as well as the loaned animal will be packaged as for overnight delivery and full and complete records will be kept and given to Robin Abernethy at the time of pick up.
