So, after the Mods warned you that you can not have more than one account, you start another account and start posting again?
Your terms and conditions do not provide a warranty on live delivery. That is your legal contract with bidders. It is what you point to when something goes wrong. Also, your terms and conditions only warrant merchandise for seven days. It clearly states live animals are not returnable. Your post does not jive with your terms and conditions.

actually you can't bid soething like fifteen dollars the auction starts at zero every bid (that costs you .55 minimum) brings the auction price up one penny

From your website: I added emphasis to relevant points.
It seems you have already removed the notation about animals not being able to be returned.
Quote:
8. Delivery:
Unless otherwise stated, delivery will be made directly from our suppliers or from our shipping facility to the address provided by the user. Deliveries are made solely within the 48 contiguous states of the United States (explicitly excluding the U.S. sovereign territories of Guam, Puerto Rico and the U.S. Virgin Islands). Please check notifications on the pages, which provide the details on each specific auction in advance. Delivery times vary and any delivery time indicated is provided only as a guide and is not guaranteed. BallBids.com shall be entitled to engage third parties to satisfy its contractual obligations without being required to notify the buyer. Obvious damage to the item or packaging during transport shall be reported to BallBids.com by the winner upon taking delivery. Should BallBids.com not be able to deliver the item ordered, BallBids.com shall promptly notify the winner if it can deliver a comparable substitute product that has the same or better features. The winner shall then promptly notify BallBids.com if it wishes to receive this substitute or if it prefers to receive a refund of the final auction end price. BallBids.com does not ship to Alaska or Hawaii.
9. Compensation for Defects:
If there is a defect in the product received and the winner wishes nevertheless to retain the product and receive compensation from BallBids.com for the reduction in value arising from the defect, the winner must provide BallBids.com with reasonably sufficient evidence of the defect and the reduction in value. Accordingly, minor defects will occasion a minor compensation to the winner by BallBids.com. The winner must make such claim within the seven (7) day period set out above and according to the same conditions.

Thank you, Derek.
Avi...I have to ask you. If your partner is incapable of understanding and following the VERY simple rules of this site, what assurances do we have that he will bother following his own rules of his own site?
And in case it wasn't perfectly clear by what Derek posted, you should have a talk with Zack and tell him to NOT create another account here. If he does, your own ability to post here will be in jeopardy and you may find it a lot more difficult to answer the questions people are asking.

Your terms and conditions state there are no warranties, no live delivery guarantees and no health guarantee and no genetics guarantee, is this correct? I've carefully read them and it says that live animals can not be returned.
To summarize, let me see if I understand this correctly:
- Zach comes on multiple forums and behaves badly.
- Once his identity has been discovered, you start posting for the company. He goes silent.
- Once his behaviors have been discussed, you (not him) apologize for his actions.
- You and Zach place a banner ad that says you sold snakes that you have not sold. You state that it isn't lying, it is marketing.
- There is no guarantee of live delivery.
- There is no guarantee of a healthy animal.
- There are no returns.
- You've intentionally chosen a business model that is known to be used by scammers.
Now, we're supposed to trust you? Pardon me if I'm still a little skeptical.

I have to say, penny bidding site aside, I am totally out raged by this!! It is completely irresponsible! You are NOT auctioning of IPADS! Theses are live animals!! Just to start, your idea of QT is totally pointless and is in no way the proper QT procedure. Is it just a gesture to make people feel better cause you "quarantine" your animals?
And WHAT is this??:
"Should BallBids.com not be able to deliver the item ordered, BallBids.com shall promptly notify the winner if it can deliver a comparable substitute product that has the same or better features."
If you have the animal there and are selling said animal HOW can you not guarantee the animal bid on is the exact one being sent??!!
And that's just one example of why I believe your site is irresponsible and will just be a negative blemish on this already stressed hobby. I can just see PETA now.....:mad::mad:

Re: Ballbids.com
I never really understood the penny auction scam, but now I see the potential for it with the 15 second reset, check this out, you don't even need a product
I setup OWAL auction the #1 *insert valuable thing here* auction site
People pay to bid on *insert valuable thing here*
If you bid in the last 15 seconds, timer gets reset.
So I just make the timer reset constantly with an account owned by me, at 1 second left
once I feel pretty confident no one else is bidding on it, I win the auction.
Make fake customer testimonial about how I got my *insert valuable thing here* and im happy with it.
Rinse repeat. No *insert valuable thing here* needed.
to the post above me, thats a cookie cutter terms of service, they just copied one and put their website name in it, the most likely didn't even read it. If they did read it..... *insert phrase to question their intelligence*

In other words..... If we don't happen to have what you bid on, we will either offer you whatever we happen to have, if we have something, or you get your 15 bucks or so of ending auction price (no matter how much you spent on expensive bids) back.
I love how the winner is referred to as an "it" BTW. I think that I'll pass on this kind of reptile auction.

My favorite part is the first few lines from from the warranty disclaimer. Never heard anyone use the term ball python "manufacturer". And what exactly qualifies as a used BP?

After what I just saw on there site watching the auction, It sure looks like a scam or atleast a horribly run site.
Timer just about ran out then added 1 day then the day vanished after the bids jumped up by 3 dollars then 1 hour was added onto the auction.
Seems kind of fishy

Re: Ballbids.com
I am over there watching the auctions now.
A funny thing happened - when the timer hit 0:00, the clock reset to...........
ONE HOUR
-
yeah it was odd. It added 1 day but continued with the normal count down just plus 1 day. then reset 1 hour after it hit 6 dollars. odd.

I knew that and it is why I posted it. It shows that they did not read their own terms and conditions, nor did they spend the time to make sure it worked with live animals. Just goes to show how sloppy this operation is. I also noted that they changed the terms to remove the sentence about not being able to return live animals. So, they are jumping, but I hope there has been enough traffic on the forums to warn people of what this company is all about.
The main on-line face guy, Avi has only been in reptiles for only a few weeks. I suspect that is why he has yet to answer the quarantine question to anyone's satisfaction. He is the front man in the con. The guy behind the scenes is Zach, who is unable to even comply with simple rules like no multiple accounts.
If anyone bids, at least if they have read this thread or the multiple threads on different forums, they are aware of who these people are. Caveat emptor.

Anyway, it sounds like Zack caught the new Ball owner bug and is trying to find a way to make some money other than the typical breeder path that most people take. I have no problem with that, but I do have a problem with the lack of QT and the inherent shadiness of penny auctions. It's no more than a gambling site that entices people to try and win big by getting something valuable for pennies on the dollar. I don't see Ballbids catching on and would encourage Zack to drop it and put in a little time and effort into the Ball market instead of treating them like a get-rich-quick commodity.

Glad I was only watching just to see what would happen. Sucks to be the people who spent all those bids just to have 1 more hour added on.

What they had on there FB
OK. This is what we're going to do!!
1) ALL BIDS that were placed are being refunded immediately.
2) Tonight's auctions are scheduled to end at 8:00 PM, EST.
3) If our server crashes again, we will have to postpone until tomorrow night, when we'll have a MONSTER of all MONSTER servers.
Thank you so much for your patience! You are amazing for sticking around through this!
-
And now another 30 minutes has been added on. Things seem to be working perfectly. lol
-
Just went to the page and got a server error. That's bad for an auction site....guess they need that "monster" server up and running pronto.
When I first heard of the site I was wondering what their guarantee is for health and live delivery. I can't actually find out because their site won't stay up and running long enough.

A little worse than that. He was asked by Robin (rabernet) how many snakes he had in the tank. His response was....
Quote:
I have 4 each in 3 tanks. They are all babies. Gotta get another rack to get them situated. Just needed to make something temporary for them. But im going to get a therm tommarow but i need to make sure it fits to 3 connections. I am getting this ars rack in about a month so I dont want to spend to much on it!!!
Looks like QT wasn't so important then for his own snakes. Makes one wonder how important it is now when the snakes are just a commodity to be auctioned off?
-
Has anyone let Constructors Unlimited know about this thread?

There's little left to wonder, they have already admitted they weren't going to do any true quarantine practices, just keep the snakes in a rack for 2 weeks.
Anyone else want to sell them snakes to flip?

Now you can't view the winning auctons. Something is totally wrong with this.

Re: Ballbids.com
if infact this is a scam,, or the makings of one, just think about all the people thats getting screwed. even when the qbids (or whatever it is) came out, and even now, there are still people lining up by the droves bending over and asking for it in the can.
i can see these guys making alot of quick cash from people that arent as fortunate as us (here on BP.net) to see all this pan out.
i feel sorry for all the bidders.
even if it is legit, i wouldent bid on anything that might compromise an animal.
theres 2 sides of the coin to this though,,,,, i WOULD bid on a animal from a well known breeder that might just need to lighten their load..
BUT,, this ballbids just reminds me too much of a puppy mill.
just my thoughts
spooky

This thread is hilarious, I can't believe I just read every page since I stopped the other day at five but it was worth it! On a less funny note this is so obviously either a scam or a very poorly run website/business venture. Either way those poor people are getting screwed with their money taken from this scam or receiving a possibly sick snake that has not been quarantined and has been stressed out from being housed with multiple snakes and that is being flipped for a profit. If he doesn't know enough about snakes to quarantine his own snakes and keeps multiple snakes in the same tank, what makes you think that the conditions for these snakes being flipped with be any better? I urge you not to do business with these people.

Either I don't like it because it's a serious market crasher, or I don't like it because it's false advertising and a scam/rip-off.

Ball Bids
I hate to bring attention to this, but I felt a need to share my opinion. There’s a “new” website called BallBids, where you bid a penny on a morph Ball Python. How it works is you pay for your bids, average of .60 or so. Each bid the animal goes up a penny. The auction goes for a few days, so in the end a $350 snake sells for $4. Keeping in mind that every bidder has lost money except for the winner, who has gotten a great deal on a snake. Now there have been “penny” bidding sites for a long time, with lots of them being shut down as scams. To me buying a laptop for $3 is a different story then buying an Albino Ball Python for $5. These are living animals and the care of the animal and the after the sale support will be non-existent.:cens0r:
For now all the animals being auctioned off are from Mike Willbanks from Constrictors Unlimited. Mike is a good friend of mine and has great animals and a good reputation. I have not spoken to him about this, but I hope he does not realize what part he has to do with “cheapening” our hobby as well as having no concern for the animals only money. Knowing Mike like I do, I have to imagine that he will “run” away from this as quick as he can. He is a good guy and cares for his animals and our hobby.:cens0r:
I am curious about your opinions. First, what do you think about this “penny” business model selling animals and second, do you think that you will still support the breeders that supply animals to this “make a buck quick” website.
I am hoping and praying that this site closes soon, not because I am concerned about the prices of animals, but the way the rest of the world sees how we treat our animals. These are incredible creatures that are alive! Not object that are valued at pennies to make “one” person a lot of money!

Re: Ballbids.com
Wow this turned out to be far more hilarious than I anticipated.
Here's what I feel like is really going on:
1. The site appears to have been thrown together by somebody with very little patience, let alone knowledge regarding marketing or website construction. The odds that the person behind the site will pay any attention to the health of the animals or the satisfaction of the customer are slim to none.
2. If the website creator really cared about anything other than making a quick buck, more attention would have been paid to details like how the timer would behave, whether the website would be able to handle the traffic, and whether the terms of service were written by Best Buy. Once the money is in his pocket, he's going to be gone.
3. The site is likely set up in such a way that the timer will repeatedly reset if a certain profit has not been attained. To bidders watching the auction, it would appear as though other users are bidding, causing the timer to reset. This process would continue until a certain amount of money has been accrued. I highly doubt that it's an accident, or the fault of the 'server'. It's probably intentional, and extremely sloppy programming.
So in conclusion, I am absolutely not going to give this person any of my money. The fact that one individual person might get away with a morph for pennies on the dollar does not justify the means that it took to make it happen. IF anybody gets the snake cheap, it means that hundreds of others spent heaps of money in exchange for NOTHING. Hundreds of people get ripped off while one person is pleased with themselves for being a jackass and lining the pockets of a scumbag. In the meantime we are COLLECTIVELY shat on. The whole community.
It DOES matter to me that his practices are impatient, sloppy, underhanded and dishonest. I do not want somebody like this to make any money at the expense of weak-willed people and innocent animals.
