    I think he is way past the due date Albert. Last payment was 11/2/16. The auction was on 9/12/16.

    Oh! Ok , I missed the dates. Thanks for the clarification. Then in this case i have to say the verbal/ written agreement concerning the banana female is null and void. Any 20% down payment towards the snake should be the sellers. Totally up to the seller to renegotiate on the basis of the natural disaster. The 20% non refundable deposit was understood correct?

    I had a few failed payment plans in the past.

    Here is what I have done

    I always contact buyers 7 days prior to the due date unless they have been communicating throughou the lenght of the plan.

    I contact them the day after the due date to tell them that their payment is overdue and that plan was extended for an additional 2 weeks.

    If not paid at the end of the additional two weeks and if the buyer faild to communicate I will send a final email explaining that due to failure to complete the terms of the plan and due to the lack of communication, the transaction is now void. (At that time the animal is re-listed and any payments made minus the non refundable deposit are returned)

    The longer the plan the more you run into this type of issue, never had issue with 30 or 60 days plans but I have run into issues with 90 days plans.

    Communication is key in payment plans, I am lenient but if I have to hunt you down and you don't communicate .....I won't be as lenient.

    Majority of payment plans are successful but every now and than you will run into this, if your buyer has issue (yes it does happen) and if he communicates you can try to work with him, however if he ignores you than go by your terms.

    So he message me back and I gave him until today to send money and he doesn't have it and I tell him that I will be refunding the money and he keeps telling me to keep it would you guys just send it back the money regardless of him telling me to keep it what would you do

    I would refund the money minus the non refundable deposit. (If you have such a thing in place)

    If he has only made a non refundable deposit than you are entitle to keep it (cost of housing, feeding, loss of sale etc)

    That's what I was going to do he has paid more than the non-refundable deposit but he keeps telling me to keep the other money but I don't feel comfortable and that I'd rather just refund him the money minus the deposit and then call it even

    This is also what I would do. That way he can't claim he paid and you never refunded and never sent anything either.

    When you do correspond with him and send any monies back make sure to put everything down on paper and try to get him to sign all documentation. Unless of course all payments were done through paypal and then you have a running record of it. Signed documents will fortress your case though. Kudos to you.

    Yes I have only used paypal with him and will be refunding the money through paypal with an attached note. Thank you everyone for all of your help.
