It wouldn't be right, nor would it be original.

It'll be confusing for the Reptile Community online to have two Vail Reptiles...but legally as long as you're in a different state you're good to go, that is, if you're going to register the assumed name with the state of Texas.

However, looks like the domain is his, you'll have to change yours...

Ok, I think I will change it so there is no confusion and in the event the other vail reptiles does something he shouldn't i wont be a suspect or mistaken for anything! My name will be registered. I got it! Vail ball pythons.:cow: Or J.Vail ball pythons. That sounds better. I still have a ways to go though.

Maybe just change the spelling on yours. lol like vale reptiles instead of vail reptiles. :oops::P
