New York State Assembly Bill 2869 - Introduced January 18, 2013

On January 18, 2013, Assemblywoman Barbara M. Clark (D-Queens Village) introduced Assembly Bill 2869 which was referred to Agriculture the same day. A2869 seeks to criminalize all ownership of wild animals or reptiles “capable of inflicting bodily harm upon a human” as a felony.

370. PROHIBITION OF THE OWNERSHIP, POSSESSION OR HARBORING OF wild animals and reptiles. Any person owning, possessing or harboring a wild animal or reptile capable of inflicting bodily harm upon a human being is guilty of a CLASS E FELONY AS DEFINED BY THE PENAL LAW.

A horse nearly fractured my femur once when I was 10, we should make owning them a felony too. Just think of it, bodily harm to children is possible! :rolleyes:

This stuff just moves from state to state. Our politicians have this idea that they know how everyone should breathe, eat, sleep and live. I'm sick of it.

When I was a kid, I had a cat bite my thumb and break the nail down in the quick.

Lets redefine 'Bodily harm'.

Any animal can cause bodily harm... I highly doubt it will pass but wow. That's incredibly ridiculous.

We have already been in touch with the sponsoring Assemblywoman's office, and they are quick to acknowledge that the current wording is very unclear, and said that they are already working on a revised proposal. They claim that they are not looking to increase the number of species beyond what is already restricted in NY, but rather increase the penalties on those with illegal animals, or where the public is actually harmed. The terrible incident in CT with the chimp a couple of years back seems to be what they are zeroing in on. It is not close to being voted on formally yet, as it would have to go through multiple committees first (currently under review by Agriculture, where other forms of this bill have died over the past few years).

This is bill certainly should be monitored closely, but I am hopeful that the end result will not effect most herpers here in NY. When I hear more, I will update.

Not that I'm happy with the reptiles currently banned but I'm so happy to hear this isn't going to go after other species. Still will be waiting to see how this plays out before I start a rack full of carpets

This will be a big change right now if you own them the DEC will just take them and might have to pay a fine. A class e felony is punishable by 2-5 years in prison.
