No, the only woods that can be toxic are pine and cedar. Pine boards are alright IF they've been well dried so the oils are not present.
As for sealing, water-based polyurethane or (what I use) Rust Olium Latex-based paints work just fine. The latex base only needs one or two coats, but the poly needs several. :)

most cheap plywood is in fact fir or pine

i think there is also a risk of formaldehyde with ply woods.

Plywood is just fine. There is no formaldehyde risk with plywood. Only some particle Boards use may contain some. Just seal it with Polyurethane. Poly is rated as safe for childrens toys and food serving areas when completely cured. Any resins or "toxins which might be in the wood are then sealed.

hate to disagree but
"Plywood for indoor use generally uses the less expensive urea-formaldehyde glue which has limited water resistance, while outdoor and marine grade plywood are designed to withstand rot, and use a water resistant phenol-formaldehyde glue to prevent delamination and to retain strength in high humidity."
most industrial glues will have some sort of formaldehyde based glue. i used a form a formaldehyde to preserve animals. we use formalin. it kills animals in seconds. not sure i would want my animals resting on a tissue preservative.

Melamine on the other hand is similar (bonded partial board) BUT it's got the coating already on it to make it water resistant. Partical board you'll have to either coat ti with something, non-toxic, or "title" it with vinil tile ot shower board & seal it well. For all the hassle you could have just used the Melamine & seal the joints & cap the edges. Both materials are heavy, so depending on what you are building you may want casters.
