US Fish and Wildlife Service strike again......
The U.S. Fish and Wildlife Service (FWS) has posted their final rule regarding five species of Sri Lankan tarantulas. The species below will be listed under the Endangered Species Act (ESA). The rule becomes effective on August 30, 2018.
1. Poecilotheria fasciata;
2. P. ornata;
3. P. smithi;
4. P. subfusca;
5. P. vittata.
Summary regarding the future domestic trade of these species. The below activities are prohibited under ESA:
■ Interstate and foreign commercial activity;
■ Selling or offering for sale in interstate or foreign commerce;
■ Import or export (without a permit from FWS for conservation purposes);
■ Possess, ship, deliver, carry, transport, sell or receive unlawfully taken wildlife.
Intrastate Commerce and Possession are legal:
Commercial activities that take place entirely in one state involving legally acquired and captive-bred endangered or threatened species are not prohibited by the ESA. This means you may keep and/or breed ESA-listed species (although state laws may apply). No CBW permit (see below) is required for intrastate activity.
Offer for Sale (interstate activity):
Endangered and threatened species may be advertised for sale but the advertisement must state that no sale may not occur until an interstate commerce permit (Captive Bred Wildlife, or CBW, permit) has been obtained from the Service for both parties involved.

Government just wanting more pie, nothing new here. To my knowledge, only one or two of those species are truly indangered, but they all will be at some point I guess.

It's just effective for wild caught specimens? I wasn't even sure they imported them anymore since they aren't terribly hard to breed.

I don't see the problem. If the government actually does something useful and prohibits the taking of wild animals for the pet trade that is all good in my book. Yes I know we would not have any ball pythons if they hadn't started somewhere - same with most species, but when the taking of the wild ones diminishes the wild population then we have gone too far and need to step away. There are plenty of captive bred snakes now - no reason to go looking for more, I would imagine the same can be said for these spiders. And if they are truly rare in the pet tread then they don't belong in it as their wild populations can't support the harvesting.
Furthermore, some animals should NEVER be in the pet trade in the first place: foxes, servals, ocelots, primates, large canines, etc. And yes, I am adamantly against "Savannah Cats", "domestic foxes" and other hybrids. I actually have clients where I work with savannahs' and they brag at how the parents of their cats were wild caught as cubs and hand raised so they would be tame. Then when the kittens they paid $$$$ for got to be about 4 months old and exhibiting their leaping/jumping/scratching wild ways, they had them declawed. Now they are obese, angry, and developing painful arthritis - they are 5 years old. I can't look at those people and my heart aches for the cats as it is not their fault they were born of ignorance and for "designer breed" status.
In some species' cases harvesting for the pet trade decimates populations as fast as habitat loss and poaching.

Well now I can’t get any of the above Pokies unless the breeders are located within my state. Yes there are “loop holes” buts I’ve dealt with enough red tape in my time to know it’s not worth it. Just sucks for those reputable breeders that won’t have the potential market now because of it.

Kinda reminiscent of the ban they had on Burmese and other large constrictors there for a while, and nobody took that as a good thing.....
