Trademark
Anyone here have experience with trademarking their name? I did do some research but I'd like to hear from those on the site who have been through it and explain what was entailed, complications and about how much it cost(attorney, name search,ect.) Anyone who running their herp biz under an untrademarked name can weigh in as well. Thanks.

In Ohio it is a $125 fee to become an LLC / LTD. Until you get that legally you can not use LLC or limited or any of that stuff after your company name. Also until you get that anyone can apply for it using the name you are currently using. As far as trademarks go the wife went through an online graphic design company and they generated a logo for us. Once we did all the back and forths coming up with a final product we recieved a certificate of ownership of the "Art Work" that includes the origional artists name, company, and date of creation all notorized and signed over to my wife. All of this offers protection in the fact that a date of creation exists and is documented, but it still is not registered. Which means we couldn't go after someone using it on the grounds of trademark infringement, but we could go after them on theft of intellectual property. At which point they would have to have some better supporting documentation than ours that they came up with the design before the date on our documentation. For the purpose of selling stuff that is not getting stamped with a logo we are pretty safe, but if we went into selling in animate objects that could be stamped with a logo like sneakers then a trademark is most definately needed as trademark infringement is a much more serious crime than copyright infringement or theft of intellectual property.

Trademarks are fairly easy to get but you need to make sure you trademark the right thing and everything.. for example
"Wildmorph's, Wildmorph Pythons and the Stylized snake Knot are registered Trademarks of Wildmorph Pythons LLC a registered company with the state of Mississippi" You want to register you logo or any image that you intend to take the place or accompany your Company name and any variations of Company Id I.E Wildmorph's and Wildmorph Pythons.
