July has brought us almost zero rain or cool weather; instead gracing us with an overabundance of proposed bans and a need for letters. While LA Pet Fair and IHS were some fun highlights, in between there was a trip to CITES, a problematic ordinance in Alabama, and that's not including preparing for the federal Endangered Species Act comments, continued work on big problems, and more.</TD>

CITES (the Convention on the International Trade in Endangered Species) is the international trade and environmental treaty that ensures trade in wildlife and wildlife products does not threaten species with extinction. The core mission of CITES is to ensure trade in species listed under the Appendices is legal, traceable, and sustainable. The Animals Committee usually meets twice intersessionally, that is between meetings of the Conference of the Parties, where the 185 nations that have signed the Treaty meet to decide to list, delist, uplist, or downlist species on the Appendices and discuss and vote on other substantive matters of the Treaty. The role of the Animals Committee is to provide scientific advice and guidance to the Conference of the Parties, working groups and the Secretariat, deal with nomenclatural issues, undertake reviews of species listed under the Appendices, particularly when there are discrepancies in trade data, or it is believed the species may be subject to unsustainable trade. The Animals Committee also drafts resolutions for consideration by the Conference of the Parties. <br />
The 34th meeting of the CITES Animals Committee was held in Geneva, Switzerland, July 13-17. USARK attorney David Garcia attended under the USARK flag, and Art Parola represented USARK and allied organizations while officially speaking for the National Animal Interest Alliance (NAIA).<br />
During the meeting, many items on the agenda were relevant to USARK members. Several lizard, snake, and scorpion species were chosen for reviews of significant trade to evaluate quotas and ensure trade is sustainable. Marking requirements were discussed, including ensuring that requirements are appropriate for the physiology and welfare of each species. This is important because some species are too small or possess other characteristics that make implantation of a microchip impossible to perform safely. Conservation of amphibians, turtles, and tortoises was also on the agenda. One of the most important items on the agenda was the introduction of a proposal to consider updating the criteria for listing of species under the appendices to ensure that listing effectively aids in the conservation of the species.<br />
USARK was included in several intersessional working groups formed at the meeting of the Animals Committee. This is in addition to the intersessional working groups formed at the Conference of the Parties last year, which USARK continues to actively participate in.<br />
USARK&#8217;s continued participation in CITES is vital, as well as over 1,000 species of reptiles, over 380 species of amphibians, and a significant number of pet invertebrate species such as tarantulas and scorpions are listed under the appendices. While regulation under the CITES Treaty can aid in the conservation of a species, there is also the potential for listings and regulation to harm conservation by hindering captive breeding or creating conditions that incentivize poaching. In its participation, USARK seeks to promote policies aligned with CITES' core mission to ensure trade in listed species is legal, traceable, and sustainable. <br />

<b>From TPWD:</b> The proposed amendment to §55.651, concerning Definitions, would define “animal control authority” as “the local governmental entity responsible for regulating and/or enforcing laws applicable to the possession, control, welfare, and disposition of animals.” The department has received numerous requests from various law enforcement and first-responder entities for assistance in identifying places and locations where persons may be holding dangerous exotic snakes, because first-responders find it helpful to know about the possibility of encountering such animals in the course of their duties, and because there may be local ordinances and laws that apply to such situations… As noted earlier in this preamble, the department believes it is prudent to create a mechanism for first responders to be aware of situations in which captive dangerous snakes are present and could be encountered. To do so, the proposed amendment would establish a notification requirement and specify criteria for determining compliance.”<br />

The Mobile City Council has proposed a new animal ordinance. Local stakeholders should engage in the process and monitor this issue. While no broad ban is proposed, there could be serious implications for animal owners, especially those who do animal outreach. This is scheduled to be discussed at the August 4 City Council meeting.<br />
Among the potential problems, all snakes, non-domesticated animals, and some dog breeds and mixes will be labeled as &quot;high-risk animals.&quot; High-risk animals will not be banned, but they must be &quot;under physical restraint&quot; at all times. This means that they must be &quot;controlled by a physical leash, chain, cord, or similar means.&quot; If an educator takes a corn snake or tortoise (as all reptiles are non-domesticated) to a program, that animal needs to be on a leash or similar device per the proposed language. While likely an oversight, this poses a problem.<br />

This applies to aquarium fish, birds, reptiles, and all other animals if you live on a lot less than one acre. Larger properties have different pet limits. The Maryland Department of Natural Resources (MDNR) has been working on changes to the state’s herp regulations. MDNR staff has already presented one proposal at several meetings to ban the possession of all native Maryland herps, including captive-bred animals. There is no timeline yet, but a formal proposal is expected to happen at any time. All Maryland stakeholders are encouraged to join the Maryland Amphibian and Reptile Conservation Charitable Trust (MAARC) Facebook group for updates. The ordinance also specifically bans any “nondomestic animal.” While this extreme ban may not be the intent, the language used bans most animals. This would be a good time for residents to address problems that they have with the current ordinance. The city already has pet limits. One pet limit bans anyone from having more than six animals in any combination, and not more than four dogs and cats in total (i.e., 3 cats and 2 dogs would be illegal without a permit). This applies to aquarium fish, birds, reptiles, and all other animals if you live on a lot less than one acre. Larger properties have different pet limits. A permit is available to have more than the limit of dogs, cats, and chickens, but not other animals. The Mobile City Council has proposed a new animal ordinance. Local stakeholders should engage in the process and monitor this issue. While no broad ban is proposed, there could be serious implications for animal owners, especially those who do animal outreach. This is scheduled to be discussed at the August 4 City Council meeting.<br />
Among the potential problems, all snakes, non-domesticated animals, and some dog breeds and mixes will be labeled as &quot;high-risk animals.&quot; High-risk animals will not be banned, but they must be &quot;under physical restraint&quot; at all times. This means that they must be &quot;controlled by a physical leash, chain, cord, or similar means.&quot; If an educator takes a corn snake or tortoise (as all reptiles are non-domesticated) to a program, that animal needs to be on a leash or similar device per the proposed language. While likely an oversight, this poses a problem.<br />

The Maryland Department of Natural Resources (MDNR) has been working on changes to the state’s herp regulations. MDNR staff has already presented one proposal at several meetings to ban the possession of all native Maryland herps, including captive-bred animals. There is no timeline yet, but a formal proposal is expected to happen at any time. All Maryland stakeholders are encouraged to join the Maryland Amphibian and Reptile Conservation Charitable Trust (MAARC) Facebook group for updates. MDNR already regulates the possession, breeding, and sale of native herps through permits and licenses. Many species are protected and not allowed to be possessed.The Maryland Herp Club (previously called the Maryland Herpetological Society) provided MDNR’s herpetologist with a 25-page set of recommendations and regulatory changes that agree to some amendments to Maryland’s herp regulations, but not a broad-sweeping ban. The Herp Club’s recommendations rejected the possession ban on all Maryland native species and provided evidence to discredit the biased reasoning behind the proposed bans.<br />

FWS has concluded that the submitted petition presents substantial information indicating that listing the diamondback terrapin as a threatened or endangered species may be warranted.<br />

The California Fish and Game Commission will discuss regulations on commercial use and possession of native rattlesnakes at its August 12-13 meeting. Twelve dedicated herpetoculturists attended, and five spoke in opposition to the proposal. No one appeared in support. The speakers did a tremendous job representing responsible herpetoculturists. Phil Goss was there to represent USARK and our members. While this is a permitting system, the requirements are extremely burdensome and completely unfair to current owners. It could prove to be a de facto ban if permits are not issued for any reason at the agency's discretion. The agency representatives tonight were very receptive, and we appreciate their time, but they were with a separate department from that overseeing these permits. Comments are allowed until May 20.<br />

Pennington County in South Dakota has proposed a ban on all non-domesticated animals. This would ban most species kept as pets, including aquarium fish, parrots, reptiles, amphibians, hedgehogs, and more. The ordinance also specifically bans any “nondomestic animal.” While this extreme ban may not be the intent, the language used bans most animals. A new 520-mile gas pipeline could tear through some of the most important riparian areas in the Southwest: the Muleshoe Ranch Preserve and Cooperative Management Area and the Middle and Lower San Pedro River Valley.<br />

<i>This isn&#8217;t a minor detour</i>. The proposed route runs along I-10 almost the whole way, but veers off to cut through fragile grasslands and riparian canyons that are home to 17 Threatened and Endangered species and 113 Species of Greatest Conservation Need.<br />

There&#8217;s no good reason for it. The company could just keep following I-10, a corridor already carved up by highways and pipelines. Instead, they&#8217;re choosing to bisect the second largest unfragmented landscape in the Southwest.<br />

The Mobile City Council has proposed a new animal ordinance. Local stakeholders should engage in the process and monitor this issue. While no broad ban is proposed, there could be serious implications for animal owners, especially those who do animal outreach. This is scheduled to be discussed at the August 4 City Council meeting.<br />
Among the potential problems, all snakes, non-domesticated animals, and some dog breeds and mixes will be labeled as &quot;high-risk animals.&quot; High-risk animals will not be banned, but they must be &quot;under physical restraint&quot; at all times. This means that they must be &quot;controlled by a physical leash, chain, cord, or similar means.&quot; If an educator takes a corn snake or tortoise (as all reptiles are non-domesticated) to a program, that animal needs to be on a leash or similar device per the proposed language. While likely an oversight, this poses a problem.<br />

The Maryland Department of Natural Resources (MDNR) has been working on changes to the state’s herp regulations. MDNR staff has already presented one proposal at several meetings to ban the possession of all native Maryland herps, including captive-bred animals. There is no timeline yet, but a formal proposal is expected to happen at any time. All Maryland stakeholders are encouraged to join the Maryland Amphibian and Reptile Conservation Charitable Trust (MAARC) Facebook group for updates. MDNR already regulates the possession, breeding, and sale of native herps through permits and licenses. Many species are protected and not allowed to be possessed.The Maryland Herp Club (previously called the Maryland Herpetological Society) provided MDNR’s herpetologist with a 25-page set of recommendations and regulatory changes that agree to some amendments to Maryland’s herp regulations, but not a broad-sweeping ban. The Herp Club’s recommendations rejected the possession ban on all Maryland native species and provided evidence to discredit the biased reasoning behind the proposed bans.<br />

The notice contains the 90-day findings for 10 species, including the Diamondback terrapin (<i>Malaclemys terrapin), </i>which are proposed for listing under the Endangered Species Act. This is separate from the NOAA alert we posted regarding this species. FWS has concluded that the submitted petition presents substantial information indicating that listing the diamondback terrapin as a threatened or endangered species may be warranted.<br />

Twelve dedicated herpetoculturists attended, and five spoke in opposition to the proposal. No one appeared in support. The speakers did a tremendous job representing responsible herpetoculturists. Phil Goss was there to represent USARK and our members. While this is a permitting system, the requirements are extremely burdensome and completely unfair to current owners. It could prove to be a de facto ban if permits are not issued for any reason at the agency's discretion. The agency representatives tonight were very receptive, and we appreciate their time, but they were with a separate department from that overseeing these permits. Comments are allowed until May 20.<br />

Pennington County in South Dakota has proposed a ban on all non-domesticated animals. This would ban most species kept as pets, including aquarium fish, parrots, reptiles, amphibians, hedgehogs, and more. The ordinance also specifically bans any “nondomestic animal.” While this extreme ban may not be the intent, the language used bans most animals. The clutchmates are not useful for comparison ID because so far they are either Yellow Belly or Ivory. <br />
 I am hatching out a few more as I post this though.<br />

Anyway, she's been in this new Viv around a year, and I made her some shelves in the hope that she could potentially use them as for exercise or to better regulate her temp etc. Mainly just because the new viv was 2ft high and I thought the space would be wasted without verticality.<br />
<br />
She didn't use the shelves much for a year.. But now, to my knowledge,  she has not came down for 2 weeks.<br />
Temps are fine, she's eating well. She is actually hunting from up there and is clearly showing excitement for food whenever I open the viv.<br />
<br />
I think everything is OK, but this change of behaviour for an old female makes me wonder if I might be missing something? Maybe I have a blind spot? The temp where she's at is about 84-85f<br />

The notice contains the 90-day findings for 10 species, including the Diamondback terrapin (<i>Malaclemys terrapin), </i>which are proposed for listing under the Endangered Species Act. This is separate from the NOAA alert we posted regarding this species. FWS has concluded that the submitted petition presents substantial information indicating that listing the diamondback terrapin as a threatened or endangered species may be warranted.<br />

It could prove to be a de facto ban if permits are not issued for any reason at the agency's discretion. Pennington County in South Dakota has proposed a ban on all non-domesticated animals. This would ban most species kept as pets, including aquarium fish, parrots, reptiles, amphibians, hedgehogs, and more. The ordinance also specifically bans any &#8220;nondomestic animal.&#8221; While this extreme ban may not be the intent, the language used bans most animals. The Maryland Department of Natural Resources (MDNR) has been working on changes to the state’s herp regulations. MDNR staff has already presented one proposal at several meetings to ban the possession of all native Maryland herps, including captive-bred animals. There is no timeline yet, but a formal proposal is expected to happen at any time. All Maryland stakeholders are encouraged to join the Maryland Amphibian and Reptile Conservation Charitable Trust (MAARC) Facebook group for updates. You can request to join the group at <a href="https://us.list-manage.com/ENn_drqHlHt?e=9391cd0132&amp;c2id=68fc7bb4eff8fa3de5ea760ffaa48617" target="_blank"><font color="#0000FF">https://www.facebook.com/groups/1971574380136788/</font></a>. MDNR already regulates the possession, breeding, and sale of native herps through permits and licenses. Many species are protected and not allowed to be possessed.The Maryland Herp Club (previously called the Maryland Herpetological Society) provided MDNR’s herpetologist with a 25-page set of recommendations and regulatory changes that agree to some amendments to Maryland’s herp regulations, but not a broad-sweeping ban. The Herp Club’s recommendations rejected the possession ban on all Maryland native species and provided evidence to discredit the biased reasoning behind the proposed bans.<br />

The notice contains the 90-day findings for 10 species, including the Diamondback terrapin (<i>Malaclemys terrapin), </i>which are proposed for listing under the Endangered Species Act. This is separate from the NOAA alert we posted regarding this species. FWS has concluded that the submitted petition presents substantial information indicating that listing the diamondback terrapin as a threatened or endangered species may be warranted.<br />

<b>UPDATE 6/5/26:</b> This update will be posted in the Federal Register on June 8. FWS is reopening the comment period for 30 days on the proposed rule to list the southern hognose snake (<i>Heterodon simus</i>) as a threatened species under the Endangered Species Act. Comments previously submitted need not be resubmitted and will be fully considered in preparation of the final rule.<br />

<b>Public hearing:</b> On June 25, 2026, FWS will hold a public hearing on the proposed rule from 5:00 to 7:00 p.m. Eastern Time. The public hearing will allow an opportunity to present verbal testimony.<br />

The California Fish and Game Commission will discuss regulations on commercial use and possession of native rattlesnakes at its August 12-13 meeting. This would include rattlesnake-avoidance training for dogs (which is a popular course), educational outreach programs, as well as all other businesses and possession.<br />

<b>UPDATE: Tegus were removed from this rule change. Thank you to the dedicated herpetoculturists who spoke at the hearing and emailed DEM. </b><b>UPDATE 5/12/26:</b> The hearing was tonight. Twelve dedicated herpetoculturists attended, and five spoke in opposition to the proposal. No one appeared in support. The speakers did a tremendous job representing responsible herpetoculturists. Phil Goss was there to represent USARK and our members. While this is a permitting system, the requirements are extremely burdensome and completely unfair to current owners. It could prove to be a de facto ban if permits are not issued for any reason at the agency's discretion. The agency representatives tonight were very receptive, and we appreciate their time, but they were with a separate department from that overseeing these permits. Comments are allowed until May 20.<br />

Pennington County in South Dakota has proposed a ban on all non-domesticated animals. This would ban most species kept as pets, including aquarium fish, parrots, reptiles, amphibians, hedgehogs, and more. The ordinance also specifically bans any “nondomestic animal.” While this extreme ban may not be the intent, the language used bans most animals.
